Notice, and takedown.
If something on Vessim infringes your copyright or trademark, this is the fastest route to having it removed — and the route that creates the record the law expects.
What this covers
Three kinds of complaint go through this process: copyright in a work reproduced in a design, a registered or common-law trademark used on a product, and a person’s name or likeness used without consent.
Anything else — an offensive design, a misleading claim, a safety concern — belongs in acceptable use. Sending it here will slow it down, not speed it up.
What a complete notice contains
Email legal@makevessim.com with the subject line “Takedown notice” and all six of the following. A notice missing any of them is incomplete and we will write back asking for it, which costs both of us a day.
- Identification of the work or mark you hold rights in, with a registration number if there is one.
- The URL of each Vessim page carrying the material. One notice can list many; a notice that says “throughout your site” cannot be acted on.
- Your name, postal address, telephone number and email.
- A statement that you believe in good faith that the use is not authorised by you, your agent or the law.
- A statement that the information in the notice is accurate, and — under penalty of perjury — that you are the rights holder or authorised to act for them.
- Your physical or electronic signature.
What we do with it
We acknowledge receipt within two business days. If the notice is complete and the claim is not obviously misdirected, we remove or disable the material, stop any order containing it that has not yet been printed, and refund that order in full.
We then pass the notice to the customer who created the design, with your name and contact details attached, because they are entitled to know who is asking and to respond. If you would rather that information were withheld, say so in the notice and we will tell you before forwarding anything.
Counter-notice
If your design was removed and you believe that was a mistake or a misidentification, you can send a counter-notice to the same address within ten business days. It needs your contact details, identification of the removed material and where it was, a statement under penalty of perjury that you believe it was removed in error, and your consent to the jurisdiction of a court where you live.
We forward complete counter-notices to the original complainant. If they do not tell us within ten business days that they have gone to court, we restore the material.
Bad-faith notices
Knowingly misrepresenting that material is infringing carries liability for the costs and damages it causes. We keep every notice and counter-notice, and we will produce them. We have declined notices before where the complainant held no rights in the work, and we will do it again.
Repeat infringers
An account that attracts repeated, substantiated notices is terminated. We count substantiated notices only — one that is withdrawn or successfully countered does not count against anybody.
If you can imagine it, we can create it.
